A Way Back

Back Taxes & Unfiled Returns in Ottawa

If you haven't filed taxes in years, here is what actually happens: the returns get filed, oldest first, penalties apply only to years where you owed money, and the CRA works with people who come forward. Coming forward before the CRA contacts you keeps the most options open, including possible penalty relief through the Voluntary Disclosures Program.

Nour & Daniels Tax brings individuals and businesses across Ottawa back into compliance every month. No lectures, no judgment. We reconstruct the missing years, file them, and deal with the CRA so you don't have to.

The Honest Numbers

What not filing actually costs

The fear is usually worse than the math. Here is what the CRA charges and what it can do, verified against canada.ca.

Sources: CRA: Late-filing penalties · CRA: Collections · CRA: Voluntary Disclosures Program
SituationWhat the CRA applies
Late return with a balance owing 5% of the unpaid balance plus 1% per full month late, to a maximum of 12 months, plus arrears interest.
Repeated failure after a CRA demand The penalty doubles: 10% plus 2% per month, to a maximum of 20 months.
Late return with a refund No late-filing penalty. The penalty is a percentage of what you owe, and a refund year owes nothing.
Unpaid debt after a legal warning The CRA can garnish wages and bank accounts, register liens on property, seize assets, and keep your refunds and credits.
Relief from penalties and interest Taxpayer relief requests can reach back up to 10 years. The Voluntary Disclosures Program may provide relief when you come forward before the CRA contacts you.

A taxpayer owes $8,000 on a return filed 14 months late. The late-filing penalty is 5% of the balance ($400) plus 1% for each full month to the 12-month maximum ($960), so $1,360 plus arrears interest. Painful, but finite and predictable. Had a demand been issued after an earlier failure to file, the same return could carry a penalty of 10% plus 2% per month instead. The cheapest day to file is always today.

Haven't Filed in Years? Here's How Catching Up Works

Most people who come to us are years behind and expect the worst. The process is more routine than you think, and it starts with information the CRA already has.

  • We Pull Your CRA Records: With your authorization, we retrieve the slips the CRA has on file for every missing year: T4s, T5s, and more. Lost paperwork is rarely the obstacle people assume it is.
  • We Reconstruct What's Missing: For self-employment or rental income, we rebuild the numbers from bank statements, invoices, and whatever records exist. Incomplete is workable.
  • We File in the Right Order: Returns go in oldest first, so carryforwards, credits, and refunds flow correctly from year to year instead of being lost.

Voluntary Disclosures & Penalty Relief

The Voluntary Disclosures Program (VDP) lets taxpayers correct past non-compliance before the CRA comes asking, in exchange for possible penalty relief and partial interest relief. The program was rewritten effective October 1, 2025, so much of what you'll read online about it is out of date.

  • Timing Is Everything: The program is built around coming forward voluntarily. Once the CRA has contacted you about the issue, the door narrows considerably. If you're reading this before they've called, you still hold the better position. (Source: CRA: Voluntary Disclosures Program)
  • Complete and Done Right: An application generally needs to be complete, cover all the years involved, and address payment. A sloppy application can burn the one chance you get, which is why we prepare the full filing package before anything is submitted.
  • Honest Assessment First: The VDP isn't the right tool for every situation. Sometimes simply filing the returns is the better path. We tell you which applies to you before you commit to anything.

Self-Employed, Contractors, and Corporations Behind on Filings

Business owners fall behind more than anyone, usually because the records got messy, a bad year made filing scary, or the business simply outran the paperwork.

  • Multiple Filing Obligations: A behind business often owes more than income tax returns. Unfiled HST returns and payroll remittances stack their own penalties, so we map every obligation before filing anything.
  • Late Corporate Returns: Unfiled T2s carry the same penalty structure as personal returns and block everything from financing to dissolution. Our corporate tax accountants bring corporations current, including the bookkeeping reconstruction that usually comes first.
  • Estates With Unfiled Years: Executors regularly discover the deceased was behind. Those years must be filed before the estate can close. Our death and estate tax service works hand in hand with this one.

CRA Collections & Payment Arrangements

Once the CRA issues a legal warning on an unpaid debt, it doesn't need to sue you. It can garnish your wages or bank account, register a lien on your home, seize assets, and keep every refund and credit you would have received.

  • Filing Comes First: The CRA generally won't discuss workable arrangements while returns are missing. Getting current is what turns a collections file into a conversation. (Source: CRA: when you owe money)
  • Payment Arrangements: Once filings are in, a realistic payment schedule can usually be negotiated. We prepare the numbers and handle that conversation with the CRA for you.
  • Taxpayer Relief Requests: Where circumstances like illness, disaster, or CRA delay contributed, penalties and interest can be challenged through a relief request reaching back up to 10 years. We build the case when the facts support one.

How It Works

From years behind to fully current

The same five steps, whether you've missed two years or fifteen:

  1. A judgment-free conversation

You tell us what you know, even if it's only "I stopped filing around 2019." Everything is confidential, and nothing surprises us.

  2. We pull your CRA file

With your authorization, we see exactly what the CRA has: slips on file, years assessed, balances claimed, and any demands or warnings issued.

  3. Strategy before filing

We determine the right path: straight filing, a voluntary disclosure, or a relief request, and we walk you through the realistic outcome of each before you decide.

  4. Prepare and file every year

We reconstruct records where needed, prepare the returns oldest first, and file the complete package.

  5. Settle and stay current

We handle assessments, negotiate payment arrangements where money is owed, and set you up so next April is just a normal deadline.

Be Prepared

What to bring, even if it's incomplete

People put off this call for years because their records are a mess. Bring what exists. We retrieve and rebuild the rest.

  • Any tax slips you've kept, for any year
  • Bank statements for the unfiled years, if available
  • Business invoices, records, or even a shoebox of receipts
  • Your last notice of assessment, however old
  • Any CRA letters, demands, or legal warnings received
  • Rental property income and expense records
  • Records of major asset sales, like a property or investments
  • Photo ID so we can be authorized on your CRA file

An Ottawa tradesperson hasn't filed in five years. Three of those years were employment income with tax deducted at source, and they turn out to be refund years: no late-filing penalty applies, because the penalty is a percentage of an unpaid balance. Two years of side-contracting income do carry balances and penalties, but the refunds from the other three offset part of the cost. After filing, benefit payments he was entitled to all along start arriving. Five years of dread, resolved in a few weeks.

Help Centre

Questions? Answers.

Will the CRA prosecute me for not filing?

Failing to file when tax is owed can be charged as an offence, but prosecution is the exception, generally reserved for deliberate evasion and aggravated cases. The CRA's practical focus with ordinary non-filers is getting returns filed and balances collected, and coming forward voluntarily before they contact you is the strongest move you can make. We can't promise any specific outcome, but we can say plainly: the people who fare worst are the ones who keep waiting.

How many years back do I need to file?

Generally, every year you were required to file and didn't. In practice, we pull your CRA file and confirm exactly which years the CRA expects, then file them oldest first so credits and carryforwards flow correctly. There's no guessing involved: the starting point is the CRA's own records, not your memory.

What is the Voluntary Disclosures Program?

The VDP is the CRA's program for taxpayers who come forward to correct past non-compliance before the CRA contacts them about it. Accepted applications can receive penalty relief and partial interest relief. The program was rewritten effective October 1, 2025, so older articles describing its previous structure no longer apply. Whether it fits your situation depends on the facts, which is the first thing we assess. (Source: CRA: Voluntary Disclosures Program.)

Can the CRA garnish my wages or take money from my bank account?

Yes. After issuing a legal warning on an unpaid debt, the CRA can require your employer or bank to redirect funds, register liens against property, seize assets, and apply your refunds and credits to the debt, all without going to court. The good news: these are late-stage tools, and getting returns filed and an arrangement in place is what stops the escalation. (Source: CRA: collections.)

I can't afford to pay what I owe. Should I still file?

Yes, and this matters more than almost anything else on this page. The late-filing penalty is charged for filing late, not paying late. Filing on time, or filing now after years away, stops that penalty from growing even if you can't pay a cent today. Once returns are in, payment arrangements become possible. Waiting until you can pay in full is the most expensive strategy available.

Can I still get refunds and benefits for the years I didn't file?

Often, yes. Refund years carry no late-filing penalty, and filing is what unlocks benefit and credit payments you may have been entitled to all along. Time limits apply to how far back refunds can be paid, so the sooner the missing years are filed, the less you leave behind permanently.

I just received a demand to file from the CRA. What now?

Take it seriously and act before the deadline in the letter. A demand changes the math: failing to comply can expose you to the doubled penalty of 10% plus 2% per month on a balance owing, and it signals the file is getting active attention. It also generally affects voluntary disclosure eligibility for that issue. Bring us the letter quickly and we'll respond within the window. (Source: CRA: late-filing penalties.)

The hardest part is the first phone call

Everything after it is just process, and the process is ours to carry. Tell us where things stand, confidentially, and we'll tell you exactly what happens next.
